Obey Creek Compass Creek Committee

The Obey Creek Compass Creek Committee has been formed by the Town of Chapel Hill and the first meeting was held on July 10, 2013.  The work of the OCCC is expected to be finished by the end of 2013.  The purpose of the Committee (from Town materials) will be to review information, participate in scheduled events and serve as a conduit to the community for the purpose of providing information, soliciting community response and fostering community participation. At the end of the process, after review of a proposed conceptual plan for the property, the Committee will provide Council with a report that identifies key issues, principles, and interests to be considered in the next phase of discussions and negotiations, to be used by council in deciding on next steps. This Compass Committee report will parallel a report by a Technical Committee that documents the results of technical analyses, a review of best practices, a summary of all meetings and workshops, and a set of ideas/concepts to be considered if the Town Council and Developer decide to proceed with Phase 2.

Voluntary Mediation Law

Effective July 1, 2013, HOAs are required to consider voluntary mediation prior to any lawsuit being filed.  Disputes over timely payment of assessments, fines or fees are not covered under this requirement.  A homeowner or the HOA may initiate the mediation by contacting a mediator, who will then contact the opposing party.  Either party may decline to participate, at which time the lawsuit may be filed.  If the parties do agree to mediate, each party is responsible for one-half of the mediator’s fee and any information exchanged during the mediation is not admissible in a court proceeding.
